Terms of Service

Ascend (“we,” “us,” “our”) provides digital athletic performance programs, AI-powered recruiting tools, mental performance coaching, and related content for competitive soccer players through our website at ascend-athlete.com. Our programs include training drills, nutrition guidance, mental performance techniques, tactical education, and AI-generated recruiting emails.

You must provide a valid email address to create an account. You are responsible for maintaining the security of your account and all activity that occurs under it.

Age requirement: You must be at least 14 years of age to create an account independently. Users ages 9–13 must have a parent or legal guardian create and manage the account on their behalf. By creating an account for a minor, the parent or guardian agrees to these terms on behalf of the minor and accepts responsibility for the minor’s use of the service.

Ascend complies with the Children’s Online Privacy Protection Act (COPPA). We do not knowingly collect personal information directly from children under 13. All accounts for users under 13 must be created by a parent or legal guardian.

For accounts created by parents for children under 13, we collect: the parent’s email address, the child’s first name, age range, position, and training-related data (sessions completed, XP earned). We do not collect the child’s email address, location data, photos, or social media accounts.

Parents may review, modify, or request deletion of their child’s data at any time by contacting [email protected].

Free trial: Days 1–3 are free with no payment required. No credit card is collected during the trial.

One-time purchases (Performance System): Non-refundable after 7 days from purchase. Refund requests within 7 days can be made by emailing [email protected].

Subscription plans (Recruiting, Mentorship, Full Access): Billed monthly or annually. Cancel at any time through your Stripe billing portal or by emailing us. You retain access through the end of your billing period. No partial refunds for unused time within a billing period.

All payments are processed securely through Stripe. We never store your credit card information.

Ascend provides athletic training programs that include physical exercises such as sprinting, plyometrics, strength training, agility drills, and sport-specific movements. By using our programs, you acknowledge and agree that:

• Participation in any physical training program carries inherent risks of injury.
• You (or your child) are physically fit to participate and have consulted a physician if you have any medical conditions, injuries, or concerns.
• You assume full responsibility for any injury or harm that may result from performing exercises or drills in our programs.
• Ascend, its founders, and its contractors are not licensed medical professionals, physical therapists, or certified athletic trainers.
• Our programs provide general athletic training information and are not a substitute for professional medical advice, diagnosis, or treatment.
• You will modify or skip any exercise that causes pain, discomfort, or feels unsafe.

For users under 18, a parent or guardian assumes these risks on behalf of the minor and agrees to supervise training as appropriate for the child’s age and ability.

Ascend makes no guarantees regarding athletic performance, college recruitment, scholarship offers, or any specific outcomes. Testimonials and statistics on our website (including references to D1 commitments) represent individual results and are not promises of future performance. Athletic and academic outcomes depend on many factors beyond our control including individual effort, talent, opportunity, and circumstance.

Our recruiting email system uses artificial intelligence (Claude by Anthropic) to generate personalized outreach emails. While we design the AI to produce professional, appropriate content, you are responsible for reviewing and approving all AI-generated emails before sending them. Ascend is not liable for any consequences arising from emails you choose to send through our platform.

Coaching ambassadors are independent contractors, not employees of Ascend. Ambassador commissions are paid on confirmed sales after the 7-day refund window. Ascend reserves the right to modify commission rates or terminate the ambassador program at any time with 30 days notice. Ambassadors may not make claims about Ascend that are not substantiated on our website.

All content, programs, drill libraries, branding, training methodologies, and materials on Ascend are owned by Ascend Athlete, LLC and its creators. Purchasing a program grants you a personal, non-transferable license to access and use the content for your own training. You may not redistribute, resell, share, record, or republish any program content.

You may not: redistribute or resell program content; use the service for any unlawful purpose; attempt to gain unauthorized access to our systems; share account credentials; scrape or automate access to our platform; or impersonate another person.

To the maximum extent permitted by law, Ascend Athlete, LLC, its founders (Kai Oppenheim and Miko Oppenheim), and its contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to physical injury, athletic performance outcomes, or recruiting results. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

These terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Alameda County, California.

We may update these terms from time to time. We will notify you of material changes by email or through the platform. Continued use of the service after changes constitutes acceptance of the updated terms.
